The 3-Metre Land in Front of Your Home: Do You Know the Real Rules?

3 metre public land in front of a cairns home

Most Cairns homeowners regularly mow and care for the 3-meter grassy area in front of their house.
It feels like part of your yard, but this space is actually public land managed by Cairns Regional Council.
Because of this, there are clear rules about what you can and can’t do there.

This guide explains those rules in the simplest way, so every homeowner understands their responsibilities and limits.

1. What Is This 3-Meter Area?

The land between your front boundary and the road is usually around 2–4 meters wide.
This space is not part of your property — it is part of the public road reserve. Even though you keep it up, the land belongs to Council.

2. Why This Area Exists

This front strip has an important purpose. It is used for:

  • water, sewer, and NBN services
  • drainage
  • bin collection
  • safe walking
  • clear visibility for drivers
  • access for maintenance trucks

Because the space is used for safety and services, it needs to stay open and easy to access.

3. What Homeowners Must Do

mow the grass, keep the area tidy, make sure nothing creates a hazard. Even though the land is public, keeping it neat helps preserve the street appearance and safety.

4. What Homeowners Can’t Do

Since the land is not private, homeowners can’t:

  • block or fence the area
  • place rocks, walls, or barriers
  • stop people from walking or parking there
  • plant tall plants, trees, or fruit trees
  • treat the area as their private yard

Any major changes generally need Council approval.

5. What Plants Are Allowed Here?

Only low and safe plants are allowed in this 3-meter space.

  • small ground covers
  • low native grasses
  • soft, low flowering plants
  • plants under 0.5 meters high

These plants must not block views, driveways, or footpaths.

❌ Not allowed:

  • fruit trees
  • large shrubs or bushes
  • palm trees
  • anything sharp or spiky
  • any plant taller than 0.5 meters
  • anything that restricts access to pipes or drains

Council remove plants that don’t follow these rules.

6. Can People Park on This Area?

Yes — unless signs say otherwise. The land is public. People may park or walk on this 3-meter area. Their actions must follow normal road rules. Homeowners can’t tell people to move simply because the space is in front of their house.

7. If Plants Get Damaged

If plants on this public land are damaged, remember, the area is not private property. homeowners usually can’t claim compensation. you may report the issue to Council, Council will decide what action, if any, is required. This applies even if the plants were permitted under Council rules.

8. Intentional Damage

People should not intentionally damage this space or any approved planting. If you believe someone has damaged it on purpose, you can report it to Cairns Regional Council. Council will review the situation under its local laws

Understanding these points helps avoid confusion and creates a safer, cleaner neighborhood for everyone.
